Withdraw Execution Warrant and Grant DNA Testing to Hank Skinner
Dear Governor Perry,
This year, the Texas legislators approved new standards for crime labs, compensation for the exonerated and revised statutes for post-conviction DNA. You signed those bills into law in order to improve and scrutinize a criminal justice system in need of reform. Considering that DNA testing has exonerated 275 prisoners in the United-States since 1989, including 43 in Texas, the overwhelming vote, both in the House and the Senate, in favor of the revised post-conviction DNA statute certainly is a welcome addition to the ongoing reforms you are supporting.
You signed SB122 into law on June 17, 2011. This bill is intended to ensure that if DNA evidence is available to prove someone's innocence, it can and will be tested. This revised post-conviction DNA law was authored and sponsored by legislators who strongly supported the bill for people like Hank Skinner who is set for execution on November 9, 2011.
We urge you to uphold the very standards you are promoting as part of a very much needed criminal justice reform and we ask you to demand the withdrawal of the execution warrant and that DNA testing be granted to Mr. Skinner in the best possible time. We trust you to do the right thing for justice and for the truth in Texas, before it is too late.

Hank Skinner has been on death row in Texas since 1995 for the murder of his girlfriend and her two adult sons. He has steadfastly professed his innocence and recently the State's star witness recanted her testimony.
PHYSICAL EVIDENCE EXISTS THAT HAS NEVER BEEN TESTED.
The rape kit was not tested. The murder weapons were not tested. Several hairs clutched in the female victim's hand were not tested. A distinctive windbreaker strongly resembling the uncle's found two feet from her body and covered in blood? Not tested.
Hank has repeatedly asked the local D.A. and the courts to order tests on the remaining evidence, confident they would prove his innocence.
Each time, his plea has been denied on the grounds that he did not make the request before his trial. In March of last year, Hank received a last-minute stay of execution from the U.S. Supreme Court and was granted the right to sue D.A. Switzer to seek access to the remaining physical evidence for possible DNA testing.
Despite the U.S. Supreme Court granting Mr. Skinner the right to sue for access to DNA testing, the state of Texas has continued to pursue his execution, with the sentencing judge signing a new death warrant for November 9, 2011. His defense has even offered to pay for the testing. The prosecution is actively blocking his efforts to prove his innocence.
Hank needs time to pursue his legally-earned right to sue for testing. The atrocity is that a new death warrant was signed despite the knowledge that he is in the process of fighting for access to the DNA in question. Texas, in an act of villainy, is trying to "beat the clock" and silence Hank rather than admit a mistake that could cost a man his life.
We must stop this execution and demand that the DNA be tested!
